A casual vacancy arises when a seat on the Town Council becomes vacant during the current term of the Council.

This could happen for the following reasons:

  • A successful candidate at the election does not sign the Declaration of Acceptance of Office
  • The resignation of an existing Councillor
  • The death of an existing Councillor
  • An existing Councillor ceasing to be qualified
  • An existing Councillor becoming disqualified
  • Failure to attend meetings (six month rule)

The Town Clerk must inform the BCBC Election Office when a casual vacancy occurs, stating the name of the councillor and the reason. The election office will then provide the notice of a casual vacancy and the Town Clerk must publish the Notice of Casual Vacancy in “some conspicuous place or places within the community area”. For example, on the Town Council noticeboard and on its website.
